New Filing Fees and Penalties for Elevator Filings
The DOB announced new fee schedules for Elevator Filings and Penalties. The filing feels increase to $40 per elevator for Category 3 and 5 – filed with a ELV3 or ELV3A. An affirmation of correction (ELV29) also costs $40 per elevator, while a Waiver of Penalties (EWP) runs $35.
The penalties rise more dramatically. For ELV3 and ELV3A filings, late filing fees are $150 per month for Category 1 or $250 per month for Category 3 or 5. For ELV29 filings, the Category 1 penalty is $150. These are per month, per elevator.
Failing to file increases the fines substantially. The ELV3 and ELV3A Category 1 penalty is $3,000 per elevator. Failing to file a Category 3 or 5 will cost you $5,000. ELV9 filings have the same penalty structure.
These fees are per elevator, so larger buildings may be shocked at how quickly these penalties turn into considerable sums. Best bet, as always, is to file early and correctly.
