New Procedure for Correcting Hazardous Violations
The DOB has a new procedure for correcting immediately hazardous Class 1 violations. Now, you may file a Certificate for Correction for hazardous violations immediately on remedying the problem. In the past, the DOB would not allow for the corrective paperwork to be filed until after the first ECB hearing date on the violation.
There is urgency – If you fail to file the Certificate of Correction immediately, the DOB can issue you a violation with a $1,500 civil penalty.
This filing does not excuse the violator from skipping the ECB hearing. Even though the approved Certificate of Correction may lead to the violation’s removal from the “active” state within the DOB website, the ECB hearing must be attended. Failure to attend will trigger an ECB default penalty, apparently a substantial one.
