    NYC Energy Code Compliance

    Starting today, July 1, 2010, ALL filings must indicate compliance with the NYC Energy Conservation Code (NYCECC). Rather than develop a new code, the City is using the New York State Energy Conservation Code and changing some text.

    The most critical change is that in addition to new buildings and major alterations, compliance is now mandatory for all alterations regardless of the cost or scope of work involved.

    This means that all filings (D14/Alt I/NB) must now contain a Professional Statement of Compliance, an Energy Analysis (Rescheck; Comcheck or Energy Model Report), Supporting Documentation (lighting layouts with fixture type, specifications, wattages, controls).

    Residential buildings under 3 stories do not have a lighting requirement. Residential buildings taller than 3 stories must use Comcheck for the general building spaces; dwelling units are exempt from the lighting portion.

    Landmark buildings are exempt from these requirements.

    DOB examiners have not been thoroughly trained in this code, so we should expect a significant number of plan examination objections, and a lot of confusion from the applicants, as they are just being exposed to these new requirements.

    There is also talk of there being a review fee for this work in addition to the standard filing fee. We must stay on top of this as it is changing rapidly.
